Terms of Service

These Terms of Service ("Terms") govern your access to and use of covers.cafe ("Service", "we", "us"). By accessing or using covers.cafe you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use covers.cafe. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Accounts

You are responsible for maintaining the security of your account credentials. You must not share your password or allow unauthorized access to your account. We reserve the right to terminate accounts that violate these Terms, impersonate others, or engage in fraudulent activity. You are responsible for all activity that occurs under your account.

3. User Content

covers.cafe allows you to upload, share, and display album cover art and related metadata ("Content"). By submitting Content you represent and warrant that:

• You own the Content or have all necessary rights and licenses to post it.
• Your Content does not infringe any third party's intellectual property rights, privacy rights, or any other rights.
• Your Content does not violate any applicable law or regulation.
• Your Content is not obscene, defamatory, harassing, threatening, or otherwise objectionable.

By uploading Content you grant covers.cafe a non-exclusive, worldwide, royalty-free license to host, display, and distribute your Content solely for the purpose of operating the Service. You retain all ownership rights to your Content.

4. Prohibited Conduct

You agree not to:

• Upload content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right.
• Upload content that is illegal, obscene, pornographic, defamatory, threatening, harassing, or hateful.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Scrape, crawl, or use automated means to access the Service without our prior written consent.
• Circumvent or attempt to circumvent any technical measures we use to protect the Service.
• Upload content that contains malware, viruses, or any malicious code.
• Use the Service for spam, phishing, or any other fraudulent purpose.
• Attempt to gain unauthorized access to any part of the Service or any related systems.

5. DMCA and Copyright Policy

covers.cafe respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA").

If you believe that content on covers.cafe infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent:

Your notice must include:

• A physical or electronic signature of the copyright owner or authorized agent;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the infringing material and its location on the Service (URL);
• Your contact information (name, address, telephone number, and email);
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. Repeat infringers will have their accounts terminated.

Counter-Notices: If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our designated DMCA agent at jakerobison17@gmail.com. Your counter-notification must comply with the requirements of 17 U.S.C. § 512(g)(3), including your physical or electronic signature, identification of the removed material, a statement under penalty of perjury that the removal was a mistake or misidentification, and your consent to the jurisdiction of the federal district court in your district.

6. Termination

We reserve the right to suspend or permanently terminate your account and access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including Sections 3, 5, 7, and 8) will survive.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COVERS.CAFE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OF OR INABILITY TO USE THE SERVICE; (II) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT; OR (III) ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF $10 USD OR THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless covers.cafe and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Service, your Content, or your violation of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.

11. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date. Your continued use of the Service after changes constitutes your acceptance of the revised Terms. If the changes are material, we will make reasonable efforts to notify registered users.
